Welcome to GOTCHU! The terms “we”, “us” and “our” refer to GOTCHU Ltd. GOTCHU Ltd operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated outdoor and adventure shopping experience (the “Services”). GOTCHU is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Many of our products (for example, rooftop tents, awnings and vehicle accessories) require correct installation and safe use. You are responsible for:

Ensuring compatibility with your vehicle or equipment (including weight limits, mounting systems and load ratings)
Following the manufacturer’s instructions and any local laws or regulations
Regular inspection, maintenance and safe use of the product

We are not responsible for any damage or loss caused by incorrect installation, misuse, failure to follow instructions, or use of products outside their intended purpose.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. GOTCHU Ltd reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until GOTCHU Ltd confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as GOTCHU Ltd may be unable to accommodate cancellation requests after an order is accepted, particularly because we work with third-party suppliers and fulfilment partners. If we do not accept, change, or cancel an order, we will attempt to notify you by using the email address, billing address and/or phone number provided at the time the order was made.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for unauthorised commercial resale or export. If we believe an order is high-risk, fraudulent, or linked to unauthorised resale, we may refuse or cancel it.

Some items may be dispatched directly from our trusted supplier partners. As a result, products within the same order may arrive in separate parcels.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices posted in our online store may be different from prices offered elsewhere, including third-party websites or physical stores. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. (iii) charges incurred by you will be honoured by your payment provider; and
(iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, duties and fees.

SECTION 5 – SHIPPING AND DELIVERY

We work with third-party couriers and trusted supplier partners who may dispatch products directly to you. Estimated delivery times are provided for convenience only and are not guaranteed.

While we aim to ensure timely delivery, delays may occur due to shipping carriers, customs processing, supplier issues, weather, strikes, or other events outside our control.

Once we transfer products to the carrier or fulfilment partner, title and risk of loss passes to you (this does not affect your statutory rights where applicable).

You are responsible for:

Providing a complete and accurate delivery address
Paying any customs, import duties or local taxes (where applicable)
Inspecting packages on delivery and promptly reporting any visible damage to the carrier and to us

If a parcel is returned to us or our supplier due to an incorrect address, failure to collect, or refusal of delivery, we may deduct any related costs from any refund, in line with our Refund Policy.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof, are owned by GOTCHU Ltd, its affiliates or licensors and are protected by UK and international copyright, trademark and other intellectual property laws.

All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

GOTCHU is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with GOTCHU Ltd. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and GOTCHU Ltd, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with GOTCHU Ltd.

Replacement costs
Damage to vehicles caused by incorrect installation of outdoor gear or accessories
Any similar damages

These limitations apply whether the claim is based in contract, tort (including negligence), strict liability or otherwise, arising from:

Your use of the Services
Your use of any product purchased through the Services
Any errors or omissions in the content
Any loss or damage resulting from the use of the Services or products supplied

Even if we have been advised of the possibility of such damages, our liability remains limited to the maximum extent permitted by law.

Any claim arising from incorrect installation or use of outdoor equipment purchased from us

We will notify you of any indemnifiable claim, but our failure to notify does not remove your obligations unless you are materially prejudiced.

We may assume control of the defence at your expense, and you must cooperate fully in the process.

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall be enforced to the maximum extent permitted, and the unenforceable portion shall be deemed severed.

This determination will not affect the validity or enforceability of the remaining provisions.
